Cassel & Cassel successfully tries the first two Hurricane Ian Cases in Lee County

Posted by Michael A. Cassel | Oct 25, 2024 | 0 Comments

The first two Hurricane Ian cases have been tried in Lee County, Florida, both total losses, both tried by managing partner Michael Cassel, and both full verdicts for the policyholders.

The first case was a firm client whose home was completely demolished by Hurricane Ian.  Mr. Cassel and Nicholas Reeves tried the case and, through the examination of expert testimony and legal arguments, conclusively establish the a total loss caused by wind occured before the storm surge swept away the property.

In the second case, Mr. Cassel was brought in by another firm to assist in a similar trial where a total loss occured and it was up to teh finder of fact to determine whether it was caused by wind or storm surge.  Performing voir dire, decicive cross examination of the entire defense case, legal argument, and a masterful closing, Mr. Cassel was instrumental in assisting the jury to render a finding that a total loss was caused by wind alone.

Both cases are in the post trial posture and will likely be appealed.  Should you have any questions about the cases, please reach out to Mr. Cassel for more information.
